General terms and conditions for private sales (B2C)

1. General

• 1.1 These general terms and conditions apply to all orders placed by consumers through the iMsignMo webshop.
• 1.2 By placing an order, you agree to these terms and conditions.
• 1.3 iMsignMo is a sole proprietorship located at Galgenbergstraat 10, 9290 Berlare, Belgium. Company number: BE1012.622.491. Contact: imsignmo@gmail.com .

2. Products & Personalization

• 2.1 iMsignMo offers exclusively handmade and personalized products. Photos on the website are for illustrative purposes only.
• 2.2 Because each piece is unique, slight variations in colour, finish or engraving may occur.

3. Ordering & Payment

• 3.1 Orders will be processed after receipt of payment.
• 3.2 Payment can be made via the payment methods offered in the webshop.
• 3.3 All prices include VAT, unless stated otherwise.
• 3.4 By placing an order, you agree to these general terms and conditions for private sales (B2C).

4. Delivery

• 4.1 The delivery times stated are indicative. Delays do not entitle you to compensation or cancellation, unless otherwise agreed.
• 4.2 iMsignMo ships via reliable carriers. You will receive a tracking code once your package has been shipped.
• 4.3 iMsignMo remains responsible for damage or loss until delivery to the consumer. Damage must be reported within 7 days of receipt, along with photos of the packaging and product.

5. Right of withdrawal

• 5.1 Personalized products are not subject to a right of withdrawal, in accordance with Article VI.53, 3° of the Code of Economic Law. By placing a personalization order, the customer agrees to this.
• 5.2 Because iMsignMo only offers personalized products, they cannot be cancelled or returned unless there is a production or delivery error.
• 5.3 Please contact us in advance at imsignmo@gmail.com if you have a complaint about your order.

6. Warranty & Complaints

• 6.1 You are entitled to a product that meets reasonable expectations and description.
• 6.2 If you notice any errors or damage upon receipt, please report this within 7 days by email with clear photos.
• 6.3 iMsignMo always looks for a suitable solution (e.g. repair, replacement or partial refund).
• 6.4 Legal guarantee: as a consumer, you are entitled to a legal guarantee of 2 years from delivery, for defects that are not attributable to misuse.

7. Liability

• 7.1 iMsignMo is not liable for indirect damages (such as consequential damages, lost opportunities, or loss of use), unless in the case of intentional error or gross negligence.
• 7.2 Example: If a personalized product is not delivered on time for a birthday due to a production problem, only the product itself will be repaired or replaced, not the value of the missed moment or other costs.
• 7.3 When submitting your own materials (such as photos or objects) for personalization, this is entirely at your own risk. Damage to submitted materials will not be reimbursed unless otherwise agreed in advance.
• 7.4 Additional usage and safety instructions apply to products such as the lithophane frame. These can be found on the " Lithophane Frame Manual " webpage and are also included in printed form. They must be strictly followed. iMsignMo is not liable for any damage caused by failure to follow these guidelines, as stated in the disclaimer.
  
  Disclaimer: Before using this product for the first time, carefully read all included instructions and safety precautions to ensure an optimal user experience. iMsignMo is not liable for any damage or loss resulting from failure to follow these instructions or improper use of the product. This includes, but is not limited to, ignoring the safety guidelines. We continuously strive to improve our products. This product comes with a 2-year warranty in accordance with the minimum European warranty requirements.
• 7.5 Except in cases of intentional error or gross negligence, iMsignMo's total liability is always limited to the amount of the order in question.

8. Intellectual Property

• 8.1 All designs, photos, texts and products on the website remain the property of iMsignMo.
• 8.2 These may not be copied or used commercially without written permission.

9. Privacy

• 9.1 Your data will only be used for order processing, communication and possibly the newsletter (with permission).
• 9.2 We comply with GDPR legislation. More information can be found in our privacy statement.

10. Force Majeure

• 10.1 In the event of force majeure (such as pandemics, illness, fire, government measures, etc.), iMsignMo may postpone or cancel delivery without compensation.

11. Disputes

• 11.1 Belgian law applies to all agreements.
• 11.2 In the event of a dispute, we will first strive for an amicable resolution. If that fails, the courts of the Dendermonde district will have jurisdiction.
